Ministers solution: Marriage as Justice!

Ministers solution: Marriage as Justice!

Hyderabad: The controversy in Telangana exposes a deeper and uncomfortable question — how can a sitting minister even hint at “marriage” as a solution in a case governed by the POCSO Act? The remarks attributed to Minister Ponnam Prabhakar suggesting a community-led compromise, including marriage between the accused and the minor survivor, triggered immediate backlash because they fundamentally clash with both the spirit and the letter of the law. Under POCSO, a minor cannot legally consent, making any narrative of “settlement” not just inappropriate but legally invalid. In simple terms, what may appear as a “social solution” in some traditional settings becomes a direct violation of criminal justice principles in modern India.

Sensing the gravity, the Indian National Congress leadership in Telangana moved quickly to distance itself, with Mahesh Kumar Goud reinforcing that justice for women and minors cannot be negotiated through caste, community, or compromise. The statement was not just damage control — it was a necessary correction in a politically sensitive case involving Bandi Sanjay Kumar’s family. By firmly rejecting the idea of marriage or mediation, the party attempted to bring the focus back to legal accountability, victim protection, and the psychological well-being of the minor.

For the common citizen, this episode highlights a harsh reality: the gap between outdated social mindsets and evolving legal frameworks. When leaders float such ideas, even casually, it risks normalising dangerous precedents where survivors are pushed toward silence in the name of “honour” or “settlement.” In today’s India, especially in high-profile cases, the expectation is clear — justice must be delivered through law, not negotiated through societal pressure. Anything less not only weakens the system but also sends a troubling message to victims who dare to speak up.
