Trump Plan Puts H-1Bs on Clock

The Trump administration is considering a major change to the rules governing foreign workers in the United States. Under the proposed regulation, H-1B visa holders and other temporary foreign workers could lose the 60-day grace period currently available to them after losing their jobs. If implemented, the move would require affected workers to take quicker action to secure new employment or make arrangements to leave the country.

At present, eligible H-1B workers who are terminated generally have up to 60 days, or until the end of their authorized stay, whichever comes first, to find another employer, change their status, or otherwise resolve their immigration situation. The proposed change could significantly reduce that window, creating additional pressure for foreign professionals who suddenly lose their jobs amid layoffs or company restructuring.

The proposal could have a particularly strong impact on Indian professionals, who make up a large share of H-1B visa holders. Workers facing unexpected job losses may have to move rapidly to find a new sponsor and complete the required immigration process. The proposed rule is part of the Trump administration’s broader effort to tighten immigration regulations and increase scrutiny of temporary foreign workers, though the final requirements could change before any rule takes effect.
